Who we are

This website is operated by Shintop Trading Australia (ABN 26 247 302 408), a sole trader based in Sydney, New South Wales. In these terms, "we", "us" and "our" mean Shintop Trading Australia, and "you" means the person using this site or placing an order.

About these terms

These terms apply when you use shintop.com.au or place an order with us. By placing an order, you agree to be bound by these terms. They work alongside our refund and returns policy, shipping policy and privacy policy, which form part of them. Where a specific policy covers something in more detail, that policy applies.

We may update these terms from time to time. The version published here when you place your order is the one that applies to that order.

Who can buy from us

You must be able to enter into a binding contract to order from us, and you must give complete and accurate details at checkout.

Our online store is set up for personal and household orders. If you are buying for a business — to resell, to serve in a café or restaurant, or to supply a workplace — please email hello@shintop.com.au rather than ordering through checkout, so we can quote and invoice you properly. Nothing in this paragraph removes any right you have under the Australian Consumer Law.

Prices

The price shown on a product page is the full price of that item, in Australian dollars. We are not currently registered for GST, so we do not charge GST, and nothing is added to that price at checkout apart from postage.

Postage is calculated separately at checkout, from the weight of your order and your delivery address, because it varies. You see the exact total, including postage, before you pay.

We may change prices at any time, but a change never affects an order already placed. If a product is listed at an obviously incorrect price, we may cancel the order and refund you in full rather than supply at that price, and we will email you if that happens.

Orders

Your order is an offer to buy. A contract is formed when we email you to confirm your order has been dispatched.

We may decline or cancel an order — for example if an item is out of stock, if we cannot deliver to your address, or if we suspect fraud. If we cancel an order you have paid for, we refund it in full.

About the products

We sell pre-packaged food, drink and tableware. We describe every product as accurately as we can, and where we translate Japanese packaging we say so.

Manufacturers change recipes, packaging and ingredients without notice. The pack you receive is the authority on its own ingredients, allergens, nutrition and dates — please read it, and if you have an allergy or a dietary requirement, check the pack before you eat. If what arrives does not match how we described it, that is ours to fix: see our refund and returns policy.

Photographs show the actual product wherever possible, but colours vary between screens and packaging designs change.

Delivery

We ship within Australia only. Times, costs and tracking are set out in our shipping policy.

Getting your order to you is our responsibility, not yours. If a parcel is lost in transit or arrives damaged, contact us and we will make it right. Handing a parcel to a carrier is not the end of our obligation to you.

Returns and refunds

Our refund and returns policy sets out what to do if something is wrong with your order. In short: we do not offer change-of-mind refunds on food, and your rights when an item is faulty, damaged, wrong or out of date are unaffected by that.

Your rights under the Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Among other things, goods must be of acceptable quality, must match their description, and must be fit for any purpose we have told you about.

If a product has a major problem, you may choose between a refund and a replacement, and you may also claim compensation for any other reasonably foreseeable loss or damage. If the problem is minor, we may choose to repair, replace or refund it. If a product is faulty, you are entitled to be reimbursed for the reasonable cost of returning it.

Nothing in these terms excludes, restricts or modifies those guarantees, or any other right you have under the Australian Consumer Law that cannot lawfully be excluded.

Our liability

Nothing in these terms limits any right or remedy you have that cannot lawfully be excluded or limited — including the consumer guarantees set out above, and any compensation you are entitled to for reasonably foreseeable loss or damage.

To the extent the law permits, we are not responsible for delays caused by circumstances outside our reasonable control, such as postal disruption, extreme weather or a natural disaster. This does not cut down the Delivery section above: if a parcel is lost in transit or arrives damaged, we make it right regardless of who caused it.

Using this website

You may browse, order from and share this site. You may not use it unlawfully, interfere with it, scrape it in a way that burdens it, or use it to send unsolicited commercial messages.

If you create an account, you are responsible for keeping your password secure and for activity under your account. Please tell us if you think someone else has used it.

We work to keep the site available and accurate, but we do not guarantee it will be uninterrupted or error-free, and we may change or withdraw any part of it.

Content and trade marks

The text, photographs, design and layout of this site are ours, or used with permission, and are protected under the Copyright Act 1968 (Cth) and other Australian law. Product names, logos and packaging belong to their respective manufacturers.

Please do not copy our product descriptions, photographs or site content for commercial use without our written permission.

Links to other sites

Where we link to a manufacturer's page or another website, we do so for your information. We do not control those sites and are not responsible for their content.

Privacy

How we handle your personal information is set out in our privacy policy.

Governing law

These terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of that State and of the Commonwealth of Australia.
